Tier II Chemical Reporting

Hazardous Waste Drum Storage Area

As part of the Community Right to Know Act, Texas Tier II Report is an annual (by March 1st) hazardous chemical inventory that provides detailed information on chemicals which meet or exceed specified reporting thresholds at any time during a calendar year. There are two types of thresholds that determine whether a hazardous chemical will be included on the Texas Tier II Report:

  • There are very low thresholds for any of the listed Extremely Hazardous Substances (500 pounds or the Threshold Planning Quantity in pounds for the specific listed chemical, whichever amount is less).
  • For all other “generally hazardous chemicals” [products which require a Safety Data Sheet (SDS) under the federal OSHA’s Hazard Communication Standard, the threshold for reporting is 10,000 pounds.

Annual Reporting for Used Oil Collection Centers

Used Oil Filter Storage Drum

​Used oil collection centers need to report every year (by January 25th) the amount of used oil collected the previous year.

Biennial Reporting for Used Oil Processors, Re-Refiners, and Filter Handlers

​Used oil processors/re-refiners and filter handlers need to report every two years (by January 25th) on the amount of used oil processed the previous two years.

Annual Summary Report (ASR) for Transporters of Municipal Sludges and Similar Wastes

​Transporters of municipal sludges and wastes need to report every year (by July 1st) the amount of waste transported the previous year. NOTE: Failure to submit an ASR or filing an incomplete ASR results in the maximum fee of $500.00 being assessed for the annual transporter fee.
